Heard Shri Raj Kumar Kesari, learned counsel for the petitioner.

Keeping in view the nature of the relief sought in the present petition, notice to the respondent is dispensed with.

The instant petition has been filed seeking a direction for expeditious disposal of S.C.C. Case No. 3 of 2020 (Ajeet Maliwal Vs. Surendra Kumar) pending before the Court of Additional District and Sessions Judge, FTC-II Hapur, District Hapur.

The aforesaid suit has been filed by the petitioner for ejectment of the tenant-respondent and recovery of arrears of rent.

In furtherance of the order dated 15.02.2023 passed by this Court, learned Additional District and Sessions Judge, FTC-II Hapur, submitted a report dated 22.03.2023 explaining the reasons for non-disposal of the suit, which indicates that the suit is pending for no fault of the Court. The PW 1 was examined on 03.01.2023 and on the failure of the learned counsel for the defendant to crossexamine him, the opportunity of cross-examination was closed. On 15.02.2023 the defendant respondent has filed recall application which is pending.

Keeping in view, the fact that the suit is pending since 05.10.2020, the instant petition is disposed of with a direction to the Court of Additional District and Sessions Judge, FTC-II Hapur, District Hapur to decide the Small Cause Case No. 3 of 2020 (Ajeet Maliwal Vs. Surendra Kumar), expeditiously, say within a maximum period of one year from the date of production of a certified copy of this order.
