Due to elevation of learned counsel for petitioners, notices had been issued on 17.11.2021. As per office report dated 19.12.2022, no power has been filed on behalf of petitioners no.1 and 4 while acknowledgement upon petitioners no.2 and 3 has been received back with the report that they have since deceased.
In view of aforesaid, it is evident that despite notice, petitioners have not yet put in appearance. Neither any fresh power has been filed nor has any one appeared on their behalf. The matter pertains to the year 2005 and is therefore dismissed for want of prosecution. Granting liberty to petitioners to file an application for restoration in case the cause of action survives.
