Heard learned counsel for the petitioner.

Notice on behalf of the respondents no.1, 2 and 4 has been accepted by the office of the Chief Standing Counsel.

Shri Shanker Lal, learned counsel has accepted notice on behalf of respondent no.3 and Shri Pankaj Patel, learned counsel has accepted notice on behalf of respondent no.5.

By means of the instant petition, the petitioner seeks direction in the nature of Mandamus commanding the respondents to grant the 2nd Personal Promotional Pay Scale to the petitioner.

It is stated that the petitioner has already made the matter before the department concerned by means of the representation dated 10.10.2022, however, no has been taken.

Considering the facts and circumstances and the issue raised in the instant petition which is at the first instance require to be decided by the respondent no.2. Accordingly, this Court, without entering into the merits, grants liberty to the petitioner to file a fresh representation with the respondent no.2 within a period of two weeks from today. In case, if the representation is moved within the aforesaid period, the respondent no.2 shall consider and decide the same within further period of six weeks.

It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall take a decision by a reasoned and speaking order and inform the same to the petitioner within the aforesaid period.

With the aforesaid, the petition is disposed of .
