Heard the learned counsel for the applicant, the learned AGA for the State and perused the record.
The instant application has been filed with a prayer to direct the CJM, Sitapur to decide CIS No. 1646 of 2018, under Section 156(3) Cr.P.C., Police Station Mahmoodabad, District Sitapur within a stipulated period of time.
The learned counsel for the applicant submits that an application under Section 156(3) was instituted in the year 2018 and since then the trial Court has not passed any order. He further added that the interest of justice would sub-serve if the trial Court is directed to conclude the trial proceeding and pass order within a stipulated period of time as may be fixed by this Court.
The learned counsel appearing for the State has no objection to the contention aforesaid.
In view of the aforesaid submissions, the trial Court is hereby directed to conclude the proceeding of complaint case in expedition, taking into consideration the instructions and guidelines issued by the Apex Court as well as by this court from time to time.
With the aforesaid observations, the instant application is disposed off .
