Learned counsel for the applicant has submitted that the present applicant, who is mother-in-law of the victim (since deceased), has been falsely implicated in the case as she has not committed any offence as alleged. In the FIR, general allegations have been levelled against four accused persons including the present applicant. It is further submitted that the matrimonial relations of the deceased and his husband (son of the applicant) were strained and the deceased had committed suicide by hanging herself. However, the applicant has no concern with the suicide committed by the deceased. Further, the present applicant has not instigated/ abetted the victim to commit suicide, therefore, the basic ingredients of Section 306 IPC are not being attracted in the present case. Charge sheet in this case has already been filed and there is no apprehension that after being released on bail she may flee from the course of law or may otherwise misuse the liberty. Learned counsel has further submitted that the applicant being lady, she may be enlarged on bail granting her the benefit of Section 437 Cr.P.C. Further, co-accused Gyan Chandra alias Gyani (brother-in-law of the deceased), having similar role, has been enlarged on bail by this Court vide order dated 17.01.2023 passed in Criminal Misc. Bail Application No.14445 of 2022. He has further submitted that the applicant is giving undertaking that she shall co-operate in the trial proceedings and shall not misuse the liberty of bail, if so granted by this Court. Further, the applicant shall abide by all terms and conditions of the bail order.
