Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.

The present application is filed with the prayer to quash the charge sheet No.351 of 2022, dated 28.12.2022 submitted in Case Crime No.70/2022 under Sections 147,148, 323, 504, 506, 427, 352, 308 I.P.C. Police Station Sangipur, District Pratapgarh as well as summoning order dated 17.4.2023 and entire proceedings of Criminal Case No.6416 of 2023 (State Vs. Badri Prasad Jaiswal and Ors.).

Learned counsel for the applicant submits that applicants have been falsely implicated in the present case and, charge sheet has already been filed by the Investigating OfÏcer in the most mechanical manner, therefore, kind indulgence of this Court is necessary.

After arguing at length, learned counsel for the applicants requested that liberty may be given to the applicants to apply regular bail before the court below.

Learned A.G.A. has no objection.

Considering the submissions of learned counsel for the applicants as well as learned A.G.A., present application under Section 482 Cr.P.C. is disposed of with the liberty to the applicant to file bail application either under Section 438 Cr.P.C. or 439 Cr.P.C. before the court below within two

weeks from today and in case, bail is moved, the same shall be considered and decided in accordance with the law.
