Heard learned counsel appearing for the petitioner and learned Addl. Chief Standing Counsel appearing for the Respondent No. 1.

In view of the proposed order, notices to private Respondents No. 2, 3, 4 and 5 are dispensed with.

Learned counsel appearing for the petitioner has submitted that predecessor-in interest of petitioner filed a case for mutation before the Consolidation Officer, Akbarpur, District Ambedkar Nagar and said case was decided vide order dated 8.1.2015. It has further been submitted that order dated 8.1.2015 was challenged by filing revision before the Deputy Director of Consolidation Akbarpur, District Ambedkar Nagar and said revision has been decided vide order dated 28.6.2022, whereby matter has been remanded to the Consolidation Officer for deciding the same afresh.

Learned Counsel appearing for the Petitioner has argued that matter has been remanded by the Deputy Director of Consolidation on 28.6.2022, but till date said case has not been decided by the Consolidation Officer, Akbarpur, District Ambedkar Nagar.

On the other hand, learned Addl. Chief Standing Counsel appearing for the Respondent No. 1 has submitted that once the case has been remanded by the Deputy Director of Consolidation to Consolidation Officer, Akbarpur, District Ambedkar Nagar, ends of justice would be served if a positive direction is issued by this Court for expeditious disposal of aforesaid Mutation Case No. 238/242, filed under Section 12 of the U.P. Consolidation of Holdings Act, 1953.

In view of the aforesaid submissions advanced by the learned counsels appearing for the parties, this writ petition is finally

disposed of with direction to Consolidation Officer, Akbarpur, District Ambedkar Nagar to decide Mutation Case No. 238/242, Sunra Vs. Ramanand, expeditiously, preferably within a period of six months from the date of presentation of certified copy of this order.
