Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. The present F.I.R. was lodged by moving application under Section 156(3) Cr.P.C. with the allegation that informant was cheated by the C.M.D. of the company, namely, Ajeet Kumar Gupta, who assured him that in case he deposited the money in his firm, then 40% interest will be paid but later on neither the interest nor the amount in question was refunded to him. The allegation is with regard to the fact that amount which was recovered in Ani Bullian Traders was transferred in Eye Vision India and certificate was also issued in this regard. It is further submitted that present applicant has nothing to do with the company, namely, Ani Bullian Traders or Eye Vision India and the father of applicant was the Director of the company. It is further submitted that co-accused Ajai Prakash Upadhyay @ Ajai Kumar and Dharnidhar Upadhyay have already been granted bail by co-ordinate Benches of this Court vide orders dated 30.9.2022 and 11.5.2023 passed in Criminal Misc. Bail Application Nos.11425 of 2022 and 12353 of 2022, respectively. Copies of bail orders have been produced for perusal which are taken on record. It is further submitted that the role assigned to the applicant is identical and similar to the role assigned to co-accused persons, who have been granted bail by this Court and as such the applicant is also entitled for bail on the ground of parity. The applicant is not involved in committing any offence. He next submits that the applicant is in jail since 16.4.2022 and if he is released on bail, he will not misuse the liberty of bail.
