In compliance of the order dated 20.01.2023, the appellant and the opposite party appeared before the Mediation and Conciliation Center of this Court.

The learned counsel appearing for the applicant submits that in compliance of the order of this Court the applicants and the opposite party no. 2 appeared before the Mediation Center, wherein, the parties have amicably settled their dispute and that too was reduced in writing as settlement agreement on 27.04.2023. He added that now there is no dispute or grievance in between the parties and thus the further criminal proceedings against the applicants would be a futile exercise and would amount to harassment and therefore the criminal proceedings against the applicants may be quashed.

From perusal of the record, it is also evident that in compliance of the order of this Court dated 20.01.2023, the Mediation Center has sent its report dated 27.04.2023 annexing therewith the settlement agreement dated 27.04.2023 and informed that the mediation succeeded.

The learned counsel for the State has no objection to the contention aforesaid.

After hearing the counsel for the parties and going through the report of the Mediation Center dated 27.04.2023 and the settlement agreement, it transpires that the parties have settled their dispute amicably before the Mediation Center and there seems to be no dispute remains to be adjudicated and thus the further criminal proceeding of Case No. 5063 of 2021 arising out of Case Crime No. 0032 of 2020, under Sections 498A, 323, 504, 506 of IPC and 3/4 of D.P. Act, Police Station Chhapiya, District Gonda is hereby quashed.

The consequences shall follow.
