Heard learned counsel for the petitioner as well as learned C.S.C. on the behalf of the State-respondent.

This writ petition has been moved with prayer to issued a writ, order or direction in the nature of MANDAMUS commanding the opposite party no.3 to 5 to consider the case of the petitioner for promotion to the post of Driver as the Petitioner is senior most Class IV employee who is eligible and qualified for the promotion to the post of Driver in accordance with the rules, expeditiously as early as possible.

It is submitted by learned counsel for the petitioner that he wants to move representation before the appointing authority regarding the appointment on the basis of promotion from the post of fourth class employee and seeks direction for expeditious disposal of his representation in accordance with the rules as prescribed for the appointment.

Learned C.S.C. has no objection in this regard.

In view of the submission of learned counsel for the petitioner, in case the petitioner moves a representation regarding his appointment on the post of driver on the basis of promotion before the appointing authority within 15 days from today, the same shall be decided within a period of 30 days in view of the U.P. Government Department Driver's Service Rules- 1993 as amended on 8th May, 2013.

Accordingly, this writ petition is disposed of finally.
