Shri Apoorva Tiwari, learned Counsel appearing for the respondent no. 5 who was the sole petitioner before the writ Court, says that she has died, therefore, the appeal against her stands abated.
As, the appeal itself was against her claim, therefore, the appeal is dismissed as abated.
Shri G.C. Verma, learned Counsel at this stage submits that in view of this abatement, the judgment of the writ Court itself goes and it cannot be treated as a precedent and the law is settled in this regard.
If the law is settled then it does not require any observation by this Court.
