Learned counsel for the applicant has submitted that the present applicant has been falsely implicated in the case as he has not committed any offence as alleged. By means of the impugned FIR, the entire family has been implicated including the present applicant. In the FIR, general allegations have been levelled against all accused persons of torturing and demanding dowry from the victim and her family. Cause of death is hanging and as per the post-mortem report, there is no ante-mortem injury. Learned counsel has drawn attention of this Court towards Annexure No.4 of the application, which is a suicide note of the victim wherein she has stated that she herself is taking extreme steps and her in-laws are not responsible, however, in the last line, she has indicated that "... roj roj rone se achchha ek bar ro le bas ". Learned counsel for the applicant has stated that hand writing of the victim was examined through FSL and FSL report has been filed before the learned trial court confirming the hand writing of the victim. However, learned counsel for the complainant and learned AGA are not aware about this fact.
