Heard learned counsel for petitioner and learned State counsel appearing for opposite parties no.1 and 2.

In view of order being proposed to be passed, notices to opposite parties no.3 to 8 stand dispensed with.

Petition under Article 227 of the Constitution of India has been filed for expeditious disposal of Regular Suit No.1183 of 2021 instituted by petitioner for cancellation of sale deed.

It has been submitted that although notices have been issued to defendants but as yet they have not put in appearance despite service of notice but since the defendants are deliberately avoiding appearance in suit proceedings expedite orders are required to be passed.

Considering submissions advanced by learned counsel for petitioner, opposite party no.1 i.e. District Magistrate, Rae bareli is directed to decide the Regular Suit No.1183 of 2021; Hanuman versus Smt. Vibha & Ors. expeditiously, without granting any undue adjournments to either parties.

Liberty is granted to petitioner to approach this Court again in case inordinate and unreasonable delay in decision of suit proceeding.

¶12

Benefit of this order shall be available only in case petitioner cooperates in early conclusion of the application/suit.

With the aforesaid direction, petition stands disposed of .
