Attention has been drawn towards the impugned F.I.R. wherein it has been indicated that on account of free-fight the father of the informant sustained head injury and he succumbed to such injuries during treatment. Initially the F.I.R. was lodged u/s 323, 504 and 308 IPC. Further attention has been drawn towards Annexure no. 5 which is a F.I.R. on the same date bearing Case Crime No. 230 of 2022 u/s 323, 504 and 506 IPC, P.S. Mishrikh, District Sitapur, lodged by the mother of the applicant. The aforesaid F.I.R. was lodged at 13.48 hrs on 15.5.2022 whereas the impugned F.I.R. was lodged at 15.40 hrs. on 15.5.2022. The F.I.R. from the side of the present applicant has been lodged u/s 323, 504, 506 IPC, however, on account of assault from the side of the informant / complainant of the impugned F.I.R. the present applicant, his mother and his father sustained injuries as injury report of those persons have been enclosed as Annexure no. 6. Learned counsel for the applicant has stated that from the side of the informant / complainant the dispute had arisen and they started beating up the present applicant and his parents for trivial issue. So as to escape his parents the present applicant has assaulted one blow which caused injury to the father of the informant / complainant.
