Heard learned counsel for the petitioner as well as Sri Anuj Kudesia, learned counsel for the respondents.

This Court by means of the order dated 10.10.2023, after hearing the parties, found that it was a fit case for being referred for arbitration and had proposed the name of Shri Hari Mangal Singh (Retd.)Additional District Judge, R/o Vinay Enclave, Chhota Bharwara, Near SDSN Public School and Indian Bank, Gomti Nagar Extension, Lucknow, Mobile No.9412162211 and 8299305243 to act as an arbitrator and had sought his consent.

The office report dated 07.12.2023 indicates that the consent has been received.

Accordingly, in light of the order dated10.10.2023, the Court appoints Shri Hari Mangal Singh (Retd.)Additional District Judge, R/o Vinay Enclave, Chhota Bharwara, Near SDSN Public School and Indian Bank, Gomti Nagar Extension, Lucknow, Mobile No.9412162211 and 8299305243, as a Arbitrator, who shall enter into the reference and decide the same in accordance with law.

The Senior Registrar of this Court is directed to communicate the order passed today to Shri Hari Mangal Singh (Retd.)Additional District Judge, R/o Vinay Enclave, Chhota Bharwara, Near SDSN Public School and Indian Bank, Gomti Nagar Extension, Lucknow, Mobile No.9412162211 and 8299305243 , who shall enter into the reference and decide the dispute arising in between the parties.

In view of the aforesaid, the petition is allowed .
