1. Heard Sri Siddharth Sinha, the learned counsel for the applicant, Sri Rao Narendra Singh, the learned AGA-I for the State and perused the records.

2 . The instant application has been filed seeking anticipatory bail for the applicant in Case Crime No. 130/2019, under Sections 420, 467, 468, 471, 409, 120-B IPC and Section 13(2) P.C. Act, Police Station Kalyanpur, District Kanpur.

3 . The aforesaid case has been registered on the basis of an FIR lodged on 13.02.2019 alleging that the U.P. Seed Development Corporation supplies seeds to the Agriculture Department against store receipts issued by the District Agriculture Officer. Four such receipts were found to be forged and it is mentioned in the FIR that an inquiry was conducted by constituting a committee but it could not be established as to which of the employee had forged the receipts or as to at what level the receipts were prepared.

4 . In the affidavit filed in support of the application, it has been stated that the applicant was working as an Accounts Officer in the U.P. Seed Development Corporation and he has already retired from the service and presently he is aged about 61 years. It has been stated in the affidavit that as per demand of different districts, the District Agriculture Officer received the allotment regarding lifting of the receiving of the seeds from Agriculture Department and thereafter

after being channelized through several levels, a store receipt comes before the Accounts Officer and in this capacity, the applicant had made entries of the receipts furnished before him in the records.

5 . Interim order was passed in favour of the applicant on 22.08.2023.

6. The State has filed a counter affidavit but no new fact has come into light.

7. The applicant has filed a rejoinder affidavit stating that he has already appeared before the trial court and furnished bail bonds. No violation of the conditions of interim anticipatory bail committed by the applicant is pointed out.

8. In view of above, the anticipatory bail application is allowed .
