where, he ultimately retired on 04.05.2022. The petitioner applied for pension on 24.08.2020, however, as per its Pension Payment Order which has been annexed as Annexure No.7 to the writ petition issued by the Pension Directorate, Uttar Pradesh, though the date of commencement of payment of pension is indicated therein to be 24.11.2012, however, as per the note appended to the said Pension Payment Order, the petitioner is not being paid pension for the period with effect from 24.11.2012 till 23.08.2020. The reason indicated in the said Pension Payment Order is that in terms of the provisions contained in paragraph no.930 of Civil Service Regulations, pension is payable from the date on which the pensioner ceased to be borne on the establishment or from the date of his application whichever is later. Though, the said regulation provides that this rule may be relaxed in a particular case by the authority sanctioning the pension when the delay is sufficiently explained, however, although the petitioner is said to have apprised all the authorities about the reason of delay, however, without taking any decision in terms of the said rule which permits relaxation, the petitioner is being denied his lawful dues of payment of pension for the period with effect from 24.11.2012 till 23.08.2020.
