This Court has passed the order dated 11.05.2023 which reads as under:-

"Heard.

Issue notice to respondent to show cause as to why the proceedings for contempt of the Court be not initiated against him for non-compliance of the judgment and order dated 01.02.2023 passed in Writ-A No.360 of 2023.

List on the date indicated in the notice as fresh.

The authorities while serving notice on the respondents-contemnor shall strictly adhere to the directions issued by this Court vide order dated 07.06.2021 in Contempt No. 670 of 2021."

Shri Satya Vrat Shukla, Advocate has filed Vakalatnama on behalf of opposite party no.2, same is taken on record. Shri Shukla has also produced the copy of order dated 28.07.2023 preferred by Managing Director, Pradeshik Cooperative Dairy Federation Limited, Lucknow whereby the compliance of the order of the Writ Court is said to have been done in its letter and spirit.

Shri Shukla has fairly stated that the payment pursuant to the order dated 28.07.2023 shall be paid to the applicant-petitioner within 24 hours.

Learned counsel for the applicant-petitioner has stated that if the payment in terms of the order dated 28.07.2023 is paid to the applicant-petitioner within 24 hours, this contempt petition may be disposed of finally. However, he has requested that if the aforesaid amount is not paid within time prayed by the learned counsel for opposite party no.2, he may be given liberty to file a fresh petition in the same contempt petition.

Having regard to the order dated 28.07.2023 passed by the Managing Director and statements so given by the learned counsel for opposite party no.2, I hereby dispose of this contempt petition finally but, in any case, the payment in terms of the order dated 28.07.2023 is not paid to the applicantpetitioner, the learned counsel for the appellant-petitioner may file an application in the same contempt petition.

Accordingly, the contempt petition is disposed of.

Notices are discharged.
