Heard Ms. Preeti Singh holding brief of Sri Munna Tiwari, learned counsel for the petitioner and Sri Surya Bhan Singh, learned Standing Counsel appearing for the State respondents.

The present petition has been filed seeking a direction to the respondent no. 1 to decide the Mutation Case No. 02286 of 2020, Computerized Case No. T202005440402286 (Rajendra Prasad Verma Vs. Pradeep Kushwaha) under Section 35 of the U.P. Revenue Code, 2006 within a stipulated period.

Learned Standing Counsel states that pursuant to the previous order, instructions have been received from the Tehsildar, Kasia wherein the delay in disposal of the proceedings have been sought to be explained and it has been stated that 06.05.2022 is the next date fixed in the case for objections/evidence and that efforts are being made to conclude the proceedings at an early date.

Counsel for the petitioner has not disputed the stand taken by the respondent authority. He, however, makes a prayer for expeditious disposal of the pending case.

Having regard to the aforestated facts and circumstances, the present petition is disposed of with an observation that in case the petitioner appears before the respondent no. 1 and does not seek any unnecessary adjournment it is expected that the respondent no. 1 would make an endeavour to decide the aforesaid case in accordance with law expeditiously, preferably within a period of three months from the date of presentation of a certified copy of this order, provided there is no other legal impediment.
