Heard Sri Amit Ranjan Mishra, learned counsel for the petitioner and Sri Vivek Manishi Shukla, learned Standing Counsel.

Learned Standing Counsel, at the very outset, has raised a preliminary objection that the writ petition has been filed seeking a direction to the respondent no. 3-Sub Divisional Magistrate, Shahganj, District Jaunpur, to pass final order in the application for demarcation, a copy whereof has been filed as Annexure No. 1 to the writ petition.

Since the respondent no. 3 is situate outside the territorial jurisdiction of this Court sitting at Lucknow, therefore, this writ petition is not maintainable before this Court at Lucknow.

Confronted with this situation, the learned counsel for petitioner states that the present writ petition may be dismissed as withdrawn with liberty to the petitioner to approach this Court at Allahabad by filing a fresh writ petition.

Accordingly, the writ petition stands dismissed as withdrawn with the aforesaid liberty.
