Prayer of the petitioner is that the school be named after late Sri Deepak Kumar Mishra.
He submits that the land was donated by the grand-mother of Deepak Kumar Mishra on the condition that if on the land donated any school comes up it would be named after late Sri Deepak Kumar Mishra.
Contention of the learned counsel for the petitioner is that the land was donated by the petitioner's mother with the condition that when the school is constructed over the land in question, then it would be named after her grandson. When the efforts of the petitioner to get the college named after late Sri Deepak Kumar Mishra failed, he has approached this court for issuance a writ of mandamus.
Without going into the merits of the case, we direct that the petitioner may represent his case before the Secretary, Basic Education, U.P. If the representation is filed by the petitioner afresh within a period of ten days then the same shall be decided within a period of one month thereafter.
With the aforesaid observation, the writ petition stands disposed of .
