The petitioner has assailed the award of the labour court dated 05.08.2015 passed in favour of respondent No. 3.
Sri Raj Mohan Saggi, learned counsel for the petitioner and Ms. Sumati Rani Gupta, learned counsel holding brief of Ms. Suman Jaiswal, learned counsel for respondent No. 3 submit that both the parties, namely the petitioner employer M/S Rosa Sugar Works and the respondent No. 3 workman Krishna Kumar Tripathi have arrived at a compromise and do not wish to continue the litigation any further. M/S Rosa Sugar Works has issue a demand draft No. 696330 dated 04.04.2022 issued by State Bank of India, Town Hall, Shahjahanpur on a sum of Rs. 4,00,000/- in favour of the respondent No. 3 Krishna Kumar Tripathi. The demand draft has been made over to Ms. Sumati Rani Gupta, learned counsel holding brief of Ms. Suman Jaiswal, learned counsel for respondent No. 3. The respondent No. 3 Krishna Kumar Tripathi has agreed to accept the aforesaid amount as a full and final payment of all dues and accordingly accepts as a final settlement of all his dues claimed from the petitioner.
The writ petition is disposed of in terms of the above compromise.
The award shall not be implemented in view of the aforesaid settlement.
The amount deposited by the petitioner before the court below in pursuance of order of this Court dated 18.01.2017 shall be refunded to the petitioner.
