On oral prayer made by learned counsel for the petitioners that the matter is extremely urgent as it involves demolition, we sent for the record of the case and it is heard in presence of learned counsel for the parties.
The instant petition has been filed praying for a mandamus directing the NOIDA Authority not to disturb the status quo as is in existence over the land comprising of Khasra No.767 area 1-1-10 village Agahpur, Pargana and Tehsil Dadri, District-Ghaziabad (now Gautam Budh Nagar).
Sri Anuj Srivastava, learned counsel appearing on behalf of respondent no.3 on instructions states that no demolition activity is presently being carried out against the petitioners and that in future, if any such action would be taken, it shall be after following due process of law.
Having regard to the statement made by learned counsel for respondent no.3, we dispose of the instant petition in terms thereof.
