Heard Sri Manish Goyal, learned Senior Advocate, assisted by Sri K.K. Rao, learned counsel for the petitioner and Sri Jamal Ahmad Khan, learned counsel for the respondent workman.

Present writ petition has been filed by the employer against the award dated 25.06.2021 passed by respondent no.1 - Labour Court, Agra.

By a detailed order of the date (5.5.2022), Writ - C No. - 11392 of 2022 (Managing Director, M/S Dakshinanchal Vidyut Vitran Nigam Ltd. vs. Labour Court, Agra & Anr.) has been disposed of and the impugned award has been set aside.

In view of the exact similarity of the facts and circumstances of the case, present writ petition is also disposed of on the same terms and conditions. Accordingly, the award dated 25.06.2021 and 06.09.2021 are set aside. The matter is remitted to the Labour Court to proceed strictly in accordance with law. In view of the facts noted above, in the interest of justice, it would be appropriate that the Labour Court would recall its order dated 08.06.2021 and allow the petitioner limited opportunity of time to lead evidence, not exceeding the period of three months from today. Thereafter, the matter may be proceeded so that the stage of evidence may be completed within the next three months and the adjudication case proceedings may be concluded within a further period of three months therefrom.
