The petitioner has confined his prayer only to the effect that a direction be issued to the respondent nos.2 to 4 to do the demarcate of the aforesaid land and delivery the physical possession of the aforesaid ceiling agriculture patta/lease land at Arazi No.91M area 0.530 Hect. situated at Mauza Madanpur Sukrauli, Tappa- Batesara, Pargana C.Jo, Tehsil Khadda, District Kushi Nagar.

Such a grievance of the petitioner can be examined by the District Collector, Kushinagar. The petitioner may, therefore, file a representation before the District Collector, Kushinagar.

Learned Standing Counsel appearing for the respondents states that in case such a representation is filed by the petitioner, it shall be decided expeditiously.

This writ petition is, accordingly, disposed of with a direction that in the event the petitioner files a representation along with a certified copy of this order before the District Magistrate, Kushinagar, an appropriate decision shall be taken after hearing the parties concerned, if there be any, expeditiously and preferably within a period of two months from the date of filing of the representation.

It is made clear that the Court has not adjudicated on the merits of the case which shall be examined by the District Magistrate in accordance with law.
