Heard Sri Umesh Kumar Dubey, learned counsel for the petitioner, Sri Abhinav Krishna Srivastava, learned counsel appearing on behalf of the respondent-authority.

The petitioner alleges that he has purchased the property in dispute from Smt. Chandrawati wife of Late Harish Chandra by means of a registered sale deed. On 22.3.2022 and 27.3.2022, the respondent authority tried to demolish the house of the petitioner with JCB Machine and police force.

The contention of learned counsel for the petitioner is that such an act is being undertaken without any notice and opportunity of hearing to the petitioner.

Learned counsel for the respondent-authority on instructions states that the Kanpur Development Authority has not initiated any proceeding for demolition of the house of the petitioner. He further submitted that if any such action is proposed to be taken in future, due notice and opportunity of hearing will be given to the petitioner.

Accordingly, in view of the statement given by the learned counsel for the development authority, the writ petition is disposed of by providing that the house of the petitioner shall not be demolished by the respondent-authority except after due notice and opportunity of hearing.
