Heard learned counsel for the petitioners and learned Standing Counsel for the State.

It appears that the petitioners as well as opposite party no. 3 have purchased some property from a common vendor. The sale deeds entered into with the common vendor pertain to different point of time.

It is thus clear that the petitioners and opposite party no. 3 must have been put into possession of the property purchased by them with respect to the boundaries specified in the respective sale deeds.

The grievance raised by the petitioners that the opposite party no. 3 has applied for the allotment of a petrol/diesel retail outlet and for this purpose a 'no objection certificate' is likely to be issued in her favour by the district authorities, does not confer upon them a right to intervene in the proceedings particularly when the said certificate applied for, if any, shall be restricted to the area and property purchased by opposite party no. 3 through a registered sale deed and not the property which was purchased by the petitioners under a different sale deed having different boundaries.

In case the petitioners have any grievance with respect to the identity of the boundaries, it is open to them to approach the competent civil/revenue court by initiating appropriate proceedings.

With the above observations, the writ petition is disposed of.
