Heard learned counsel for the parties and perused the record.

The instant petition has been filed inter alia for the following relief :

"(i) To issue a writ of mandamus, order or direction in the nature of mandamus commanding the respondent No. 2- Deputy Director of Consolidation, District Jaunpur to firstly decide the preliminary objection of the petitioner dated 5.9.2018/6.4.2018 before proceeding to decide the revision bearing Revision No. 1427/2021-22 (Jiya Lal Vs. Baljeet), under Section 48 (1) of U.P.C.H. Act."

It is submitted that the aforesaid objection is pending since 5.9.2018/6.4.2018. However, learned Deputy Director of Consolidation is not taking any fruitful steps to decide the aforesaid revision.

Learned Standing Counsel has no objection in case a direction is issued for early disposal of the case.

In this conspectus, as above, no useful purpose would be served to keep this matter pending, therefore, this Court deems it appropriate to finally dispose of the present writ petition without entering into the merits of the case with a direction to the Deputy Director of Consolidation (respondent no.2), before whom the application/objection dated 5.9.18/6.4.18 (Annexure-1) filed by the petitioner is pending disposal, to decide the same first before passing any final order on the revision, expeditiously, preferably, within the period of three months from the date of receipt of a copy of this order.

It is made clear that Deputy Director of Consolidation can hear the merits of revision on the same day without differing it for any next date.

It is expected that it should be decided by reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments.

With the aforesaid observations, present writ petition is disposed of.
