Heard Shri N.A. Siddiqui, learned counsel for the applicant/petitioner as well as Shri Dev Prakash Mishra, learned Standing Counsel appearing for the respondent no.1 and 2 and perused the record.

None is present for the respondent no.3.

The instant application has been filed by the petitioner requesting to permit him to withdraw the writ petition as the same has become infructuous. While referring to the affidavit of the petitioner/applicant enclosed with the application for withdrawal, it is submitted by the learned counsel for the petitioner that during the pendency of the petition, the petitioner and respondent no.3 namely Sansar Singh had entered into a compromise in Writ Petition No.195 (Cons.) of 2010; Sansar Singh and another Vs. D.D.C. Sitapur and Others decided on 04.05.2016, a copy of which has been enclosed with the application. It is vehemently submitted that in terms of the compromise entered between the parties, the petition has become infructuous and therefore, the same may be permitted to be withdrawn.

No objection in this regard has been made by learned Standing Counsel.

Having regard to the request made by learned counsel for the petitioner and having considered the averments made in para nos.2 to 5 of the affidavit enclosed with the withdrawal application, the writ petition is dismissed as being withdrawn without any liberty to file afresh.
