Heard Sri R. K. Ojha, learned Senior Advocate, assisted by Sri Sarvanand Pandey, learned counsel for the petitioner, Sri Shyam Krishna Gupta, learned counsel appearing on behalf of respondent nos.4 and 5 and learned Standing Counsel for the State respondents.
The petitioner has approached this Court against the punishment order dated 21.3.2022 passed by respondent No.4, District Basic Education Officer, Deoria.
Sri Shyam Krishna Gupta, learned counsel for respondent Nos.4 & 5 has pointed out that the petitioner has a statutory remedy of appeal under Section 7 (3) U.P. Basic Education Staff Rules, 1973, before the Secretary, U.P. Basic Education Board, Prayagraj.
This writ petition is disposed of with liberty to the petitioner to approach the the Secretary, U.P. Basic Education Board, Prayagraj by way of filing an appeal challenging the said order. In case any such appeal is filed within two weeks, the same shall be considered and decided by the Secretary, U.P. Basic Education Board, Prayagraj, within a period of six weeks thereafter from today.
