Heard Sri Satendra Kumar Sharma, learned counsel for the petitioner and Sri Amit Shukla, learned counsel for the respondent nos. 2 and 3.

With the consent of learned counsels for the parties, this petition is being heard finally at the admission stage itself.

This petition has been filed praying for direction to the respondents to make payment of death gratuity benefit to the petitioner of Late Shri Krishna Kumar Mishra, the husband of the petitioner who was posted as head teacher at Primary School, Babura, Block Bilsanda, Pilibhit, before retirement he died on 29.01.2003.

In view of the judgement of this Court in the case of Renu Gupta Vs. State of U.P. and five others, Writ-A No.14397 of 2019 , the petition is allowed.

Respondents are directed to compute the amount payable to the petitioner's husband towards gratuity in terms of the scheme and release the same, maximum within a period of three months from the date of production of certified copy of this order. The petitioner shall also be entitled to interest at the rate of 8% per annum, from the date of filing of the application till the amount is actually disbursed.
