Heard Mr. Narendra Kumar, learned counsel for the petitioner, Mr. Aseem Mukherjee, learned Counsel for the Staterespondents and Mr. B.K. Yadav, learned counsel for the respondent nos.3&5.

This writ petition has been filed interalia for the following relief:-

"a. Issue a writ, order or direction in the nature of writ of mandamus commanding the respondents authorities to change the section/Patal of the petitioner pursuant to the Government Order dated 23.06.2021 as issued by the State Government.

b. Issue a writ, order or direction in the nature of writ of mandamus commanding the respondents authorities to decide the representation of the petitioner according to the Government order dated 23.06.2021.

Learned counsel for the petitioner submits that the petitioner joined his service on the post of Junior Clerk in the office of Government Girl's Higher Secondary School Kuraoli, DistrictMainpuri. Presently, the petitioner is posted as senior assistant in the office of District Basic Education Officer, Firozabad where he is working since 04.06.2018. As per the Government Order dated 23.06.2021, the Clerks, who have completed three years of services on the same patal/section in the office of Basic Education Department need to be transferred. The petitioner has completed three years of service in the office of respondent no.5, therefore, he has moved a representation before respondent no.5 to consider his case in the light of Government Order dated 23.06.2021 but no decision has been taken till date.

Learned Standing Counsel for the State-respondents as well as counsel for the respondent nos.3&5 submit that they have no objection, in case, a fresh representation is moved by petitioner for redressal of his grievance, the same shall be decided in accordance with law.

Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed of with a direction to the petitioner to file a fresh representation along with all the documents so advised as well as certified copy of this order before the respondent no.5, i.e. District Basic Education Officer, District-Firozabad, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.5 shall consider and decide the same in the light of Government Order as well as in accordance with law, by reasoned and speaking order, preferably within a period of three months from the date of production of a certified copy of this order if there is no other legal impediment.
