Referring to the earlier order passed in Writ - A No. 13184 of 2022 (Mahatim Singh Vs. State of U.P. & 5 Ors.) decided on 02.09.2022 and relying on the observation made therein, at present, the petitioner is aggrieved by the fact, complaint made by the petitioner against respondent no.7 has remained pending before respondent no.3 since 28.07.2022.

In the above regard, it is the claim of the petitioner, if the appointment of respondent no.7 is illegal and his appointment order is cancelled, the petitioner being senior most teacher, may be given charge of officiating Principal. While claim made by the petitioner may not be examined at this stage, insofar as it does appear, certain proceedings are pending to test the validity of respondent no.7 and those proceedings are pending before respondent no.3, it does commend to the Court and that those proceedings may be decided in accordance with law expeditiously.

Accordingly, without entering into the merit, present writ petition is disposed of with a direction, in case the petitioner files a copy of this order before respondent no.3, the proceedings pertaining to the validity of the appointment of respondent no.7 may be dealt with and decided expeditiously after hearing all necessary party and making due verification of record, preferably within a period of three months from the date of compliance shown by the petitioner.
