Petitioner claims to be working as officiating Principal of the institution - Shrinath Sanskrit Mahavidyalaya, Hata, Kushinagar since 2018. Further, he claims, his signature have been attested. There is no dispute as to officiating charge. Still, commensurate salary has not been paid. He has relied on a Full Bench decision of this Court in Dr. Jai Prakash Narayan Singh Vs. State of U.P. & Ors., 2014 (8) ADJ 617 (FB) .

While the principle of law may not be disputed, at the same time, facts will have to be ascertained before that principle may be applied. That exercise has yet not been completed.

Accordingly, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit at this stage.

Present writ petition is disposed of with a direction, in case the petitioner files a fresh representation before respondent no.3 within a period of two weeks from today supported by his personal affidavit containing such documents as the petitioner may seek to rely and disclosing all facts, the said respondent may pass appropriate reasoned and speaking order after making all necessary verification of facts. That exercise maybe completed within a period of one month from the date of compliance shown by the petitioner.

Needless to add, any amount found payable, be paid out to the petitioner within a further period of one month therefrom, failing which, the same shall attract interest liability @ 8% from today till the date of actual payment.
