The dispute in the present petition revolves around the officiating charge of Principal at A.S.B. Inter College, Wair Badshahpur, Bulandshahar. While the petitioner and private respondent no.5 have set up a conflicting claims, the Committee of Management has supported the claim of the private respondent. At the same time, during pendency of the present petition, the Board has spoiled the contest between the petitioner and respondent no.5 by sending a panel candidate i.e. the regularly selected candidate for the appointment of Principal at the aforesaid institution. That superior claim destroys the basis of the contest, in this case.

Learned counsel for Committee of Management states, the duly selected candidate has yet not joined the institution.

Accordingly, to bring a quietus to the dispute and in the interest of justice, the present writ petition is disposed of at this stage with a direction upon respondent no.3/District Inspector of Schools, Bulandshahar and respondent no.4/Committee of Management of the institution to ensure that the duly selected candidate provided by the Board joins the institution, preferably on or before 31.12.2022.
