Heard learned counsel for the parties.

Contention of the learned counsel for the petitioner is that the petitioner alone was entitled for an appointment on the post of Care Taker. As per the Government Order dated 15.07.2020, the petitioner was the most deserving self help group as its office was the nearest to the Public Toilet. Learned counsel submits that the respondent No.5 had wrongly been given the work.

Learned Standing Counsel submits that the writ petition be not entertained as there were disputed questions of fact.

Under such circumstances, it is being directed that the respondent No.3, Block Development Officer Tamkuhi, Block Tamkuhi, District- Kushinagar shall decide the representation of the petitioner dated 27.09.2021 within a period of two weeks from the date of presentation of a certified copy of this order, unless there is any legal impediment.

With these observations, the writ petition is, accordingly, disposed of .
