Heard learned counsel for the petitioner and Sri Udit Chandra holding brief of Sri Subodh Kumar, learned counsel for the respondents.

This writ petition has been filed with the following prayers :-

"a. Issue a writ, order or direction in the nature of mandamus commanding the Respondent No.2 (Director General of Police (Indo Tibetan Border Police), C.G.O. Complex Block-2, Lodhi Road, New Delhi) to decide the Representation dated 12-09-2021 (Annexure No.1) along with the Reminder application dated 03-12-2021 (Annexure No.2) as pension for A.C.P. Scheme.

b. Issue a writ, order or direction commanding the Respondent No.2 (Director General of Police (Indo Tibetan Border Police), C.G.O. Complex Block-2, Lodhi Road, New Delhi) to provide the benefit of the A.C.P. as well as consequential benefit thereof, after upgradation in salary."

With regard to these very prayers, a representation has been filed by the petitioner on 12.9.2021 before the respondent no.2.

Without going into the merits of the case, it is directed that the representation filed by the petitioner on 12.9.2021 be decided by the respondent no.2 within a period of two months from the date of presentation of a certified copy of

this order in accordance with law. It is, however, provided that if the respondent no.2 finds that the representation is to be decided by any other authority, he may forward the same to the authority concerned.

The writ petition is, accordingly, disposed of.
