Heard learned counsel for the revisionist, Mr. Rajesh Kumar Dubey, Advocate holding brief of Mr. Santosh Kumar Mishra, learned counsel for respondent No.2 and learned A.G.A. for the State.

The criminal revision petition has been filed challenging judgment and order dated 1.6.2018 passed by Court of Addl. Sessions Judge/(FT No.2), Family Court, district Maharajganj in Maintenance Case No.402 of 2016 Smt. Shyamwanti versus Sunil Kumar .

Learned counsel for the revisionist submits that the revisionist was subjected to cruelty and assault soon after the marriage and that is why she remained only for five days in the house of the in-laws. It is respondent No.2 who has deserted the revisionist. therefore, the trial court has wrongly decided issue No.1 and on that basis has dismissed her application under section 125 CrPC.

Per contra, learned counsel for respondent No.2 submits that in the statement before the trial court, the revisionist has clearly stated that her parents are old. She has no brother. She only takes care of them and her husband does not come to look after her parents. In this regard, he has tried to persuade respondent No.2, however, he has paid no heed and therefore, application

under section 125 CrPC was filed by the revisionist.

A perusal of the impugned order dated 1.6.2018 shows that the trial court has framed four issues. Issue No.1 was framed as to whether the revionist is residing away from her husband, i.e. respondent No.2 for justified reasons or not. The onus to prove this fact was on the revisionist.

P.W.1, P.W.2 and P.W.3 have been examined. Both P.W.1 and P.W.2 have stated that the revisionist resided in her in-laws house for only five days. P.W.3 has stated that she returned from the place of in-laws after one week. The trial court after appreciation of the evidence has recorded a categorical finding that five days period for demanding and committing attroticies is too less and cannot be believed. It is further recorded that the revisionist has not reported the fact that she was mentally and physicall tortured. Neiher she has given any clear date regarding the said attrocities. The trial court has further considered the fact that in the cross-examination, the revisionist has stated that her parents are quite old. She has no brother and she alone takes care of them and her husband, i.e. respondent No.2 does not come to serve her parents. Relevant part of the impugned judgment is extracted below :

समझतानिसे पर लतात मदक्कता ससे मतारसे पनटसे तथता जतानि ससे मतारनिसे ककी धमककी नदए । पतारथरनिन निसे सयचिनिता दसेकर अपनिसे नपतता कको बिदलवतायता एवसं नवपकन कसे घर वतालसे कहसे नक जबि तक मकोटरसतायनकल निहीሻ दकोगसे पतारथरनिन कको निहन रखमगसे और पतारथरनिन कको उसकसे मतायकसे अपनिसे नपतता कसे सताथ भसेज नदए , तबि ससे पतारथरनिन अपनिसे मतायकसे मम रह रहन हहै। इसन कता समथरनि करतसे हहए वतानदनिन मदख्य परनकता कता शपथप्ቔ 21 क पस्तदत नकयता हहै। वतानदनिन निसे अपनिसे वतादप्ቔ मम तथता मदख्य परनकता शपथप्ቔ मम यह कहीሻ निहन रलखता हहै नक जबि वह अपनिसे ससदरताल आई तको उसकसे ससदरताल जतानिसे कसे नकतनिसे नदनिोሪ बिताद उसकसे ससदरताल वतालसे उससे पततानडत करनिता शदरू कर नदए और यह भन निहन रलखता हहै नक नकस ततारनख कको उसकसे सताथ मतारपनट ककी गई और नकस ततारनख कको वतानदनिन कको उसकसे नपतता कसे सताथ भसेज नदयता गयता। वतानदनिन निसे अपनिन पनतपरनकता मम यह कहता हहै नक मम अपनिसे ससदरताल मम 5 नदनि रहन हहाሯ मम पतचिवसे नदनि अपनिसे मतायकसे आ गई। पन ा 0 डब्ल्यय002 नपयतारसे निसे अपनिन पनतपरनकता मम यह कहता हहै नक श्यतामवन्तन गगौनिता मम जतानिसे कसे 4-5 नदनि बिताद ससे हन अपनिसे गतव मम हहै वह ा ससदरताल निहन गई। इसन पकतार पन0 डब्ल्यय0-03 बिताबियलताल जको वतानदनिन कसे नपतता हहै निसे अपनिसे सताቌኚय मम कहता नक मसेरन लड़ककी गगौनिसे मम ससदरताल जतानिसे कसे बिताद एक हपसे बिताद वतापस आनिसे पर पदनिनः अपनिसे ससदरताल निहन गई। पन0 डब्ल्यय0-01 वतानदनिन व पन0 डब्ल्यय0-02 नपयतारसे कता कथनि हहै नक वतानदनिन अपनिसे ससदरताल मम 5 नदनि और पन0 डब्ल्यय0-03 बिताबियलताल निसे कहता हहै नक वतानदनिन एक सपताह रहन हहै और ससदरताल ससे आनिसे कसे बिताद पदनिनः मतायकसे निहन गई। चियाሯनक यह स्वनकपृत तथ्य हहै नक वह मता्ቔ 5 नदनि अपनिसे ससदरताल मम रहन हहै इसरलए 5 नदनि कता समय, नवपकन दतारता उसससे दहसेज मतगनिता ा , दहसेज कसे रलए पततानडत करनिसे कसे रलए बिहहत कम हहै। यह बितात नवश्वतास करनिसे यकोग्य निहीሻ हहै नक 5 नदनि मम नवपकन एवसं उसकसे ससदरताल वतालसे वतानदनिन कको पततानड़त नकए और घर ससे ननिकताल नदए। वतानदनिन दतारता अपनिसे सताथ हहयसे मतानिरसक एवसं शतारनररक उत्पनड़नि ककी ररपकोटर कहीሻ निहीሻ ककी गई और नि हन ककोई नतरथ व मताह बिततायता गयता। अपनिन पनत परनकता मम वतानदनिन निसे यह कहता हहै नक मसेरसे मतातता नपतता वपृद हको चिदकसे हहै ककोई भताई निहन हहै। इसरलए उनिककी ससेवता मम हन करतन हहाሯ मसेरसे मतातता नपतता ककी ससेवता करनिसे मसेरसे पनत सदनिनल निहन आतसे मम अकसेलसे हन उनिककी ससेवता करतन हहाሯ मम और मसेरसे मतातता नपतता सदनिनल कको बिहहत समझतायसे नक वसे मतातता नपतता ककी ससेवता करम परन्तद वसे निहन सदनिसे ममनिसे यह मदकदमता सदनिनल कको समझतानिसे बिदझतानिसे कसे बिताद जबि वसे निहीሻ मतानिसे तबि ममनिसे नकयता वतानदनिन कसे सताቌኚय कसे उपरकोሹኌ T कथनि ससे यह स्प्ቖ हकोतता हहै नक वतानदनिन चिताहतन थन नक नवपकन सदनिनल वतानदनिन कसे मतातता नपतता ककी ससेवता करसे और जबि नवपकन इस बितात कसे रलए तहैयतार निहन हहआ तबि यह मदकदमता वतानदनिन निसे नकयता हहै।

उपरकोሹኌ नववसेचिनिता तथता वतानदनिन कसे सताቌኚय कसे उपरकोሹኌ कथनिोሪ ससे स्वयसं यह स्प्ቖ हहै नक वतानदनिन नबिनिता नकसन यदनሹኌयदሹኌ कतारण ससे अपनिसे पनत नवपकन सदनिनल ससे पपृथक रह रहन हहै। अतनः यह वताद नवन्दद निकतारतात्मक रूप ससे ननिणቓኍत नकयता जतातता हहै।

On due consideration to the argument advanced, perusal of the record as also the judgment passed

by the trial court, I do not find any illegality in the order impugned. The trial court after giving categorical finding that the revisionist was of the view that her husband should come and stay with her to serve her parents and since he did not accede to it, she was residing away from her husband and accordingly, the issue has been decided in negative and on this ground, the application under section 125 CrPC of the revisionist has been dismissed. I do not find any illegality in the order impugned.

The revision lacks merit and is accordingly dismissed.
