The respondent no. 2 was found allegedly involved in Case Crime No. 18 of 2018 under Sections 302, 307, 34 IPC and Section 7 of Criminal Law Amendment Act; an application was moved on behalf of the respondent no. 2 for declaring him a juvenile, moved before the Court of C.J.M. along with papers of Junior High School and Primary School showing date of birth as 05.01.2001. Several witnesses were examined by the Juvenile Justice Board; PW2 Sindhu Gupta of Poojan Sikshan Sansthan Harijan Prarthamik Vidyalaya, Velva Bazar, Deoria, who deposed that minor studied in Class 1st to Class 5th in his school and was issued T.C. in June 2011 showing his date of birth as 05.01.2001. PW3 Babu Ram Yadav, Principal of Adarsh Swargiya Jiyavan Uchchatar Madhyamik Vidyalaya, Velva Bazar, Deoria, who deposed that the minor studied in that school from Class 6th to Calss 8th and issued T.C. on 30.06.2014 showing date of birth as 05.01.2001. In all the papers his father’s name-Babulal Yadav and mother’s name-Asharfi Devi was recorded. However, several papers were produced by the informant prima facie showing that he studied in another institution in Class 5th showing date of birth as 08.02.1996 and in yet another institution in Jhajjar Haryana in Class 8th where date of birth is 26.07.1996.
