Heard learned counsel for the petitioner, learned A.G.A. on behalf of State and perused the material placed on record.
The contention of learned counsel for the petitioner is that an order of externment dated 12.10.2021 has been passed under Section 3 (3) of the U.P. Control of Goondas Act, 1970. The petitioner has filed an appeal against the same on 07.01.2022 along with an application for stay which is pending consideration.
Under the circumstances, the third respondent is directed to consider and dispose of the stay application filed by the petitioner within a period of three weeks from today.
It is clarified that it shall be open to the third respondent to decide the appeal itself on its merit during the said period.
With the above direction, the writ petition stands disposed off .
