Heard learned counsel for the petitioner.
By the instant petition, petitioner seeks the following relief:
"i) issue a writ order or direction in the nature of mandamus directing and commanding the respondent nos. 2 and 3 to proceed against the accused respondents nos. 4 to 10 pursuant to the report submitted for continuation of proceeding for cancellation of Arm License granted to the respondents accused and to proceed with the proceeding under U.P. Gangsters Act or to show cause within a stipulated period as fixed by this Hon'ble Court."
After arguing the matter, learned counsel for the petitioner submits that the petition be dismissed as withdrawn with liberty to the petitioner to file an appropriate application before the third respondent, Superintendent of Police, Ballia.
In view thereof, the writ petition is dismissed as withdrawn with the aforesaid liberty.
It is clarified that the Court has not considered the claim and contention of the learned counsel for the petitioner on merit.
