Heard learned counsel for the petitioner, learned A.G.A. for the State and Shri Moti Lal, learned counsel for the informant, who has filed memo of appearance.
Present writ petition has been preferred for quashing the FIR dated 05.05.2022, being F.I.R./Crime No.300/2022, under Sections 376, 406, 504, 506, 323, 352, 354 IPC, P.S. Barra, District Kanpur Nagar and for a direction to respondents not to arrest the petitioner pursuant to the impugned F.I.R.
Learned A.G.A., on the basis of instructions, has apprised the court that in this case charge-sheet has been forwarded against one of the co-accused, namely, Ramesh Kumar Pandey. So far as the petitioner is concerned, the investigation is in progress and complicity of co-accused Rahul Pandey @ Divyansh Pandey, Pooja Pandey and Smt. Ketki Pandey was not found, therefore, their names have been dropped.
Needless to say that free and fair investigation must be ensured, for which learned counsel for the petitioner states that full cooperation would be extended by the petitioner as the investigation against the petitioner is in progress.
Let the investigation be completed expeditiously.
With the above observation and directions, the writ petition stands disposed of.
