Sri Shiv Nath Singh, learned Senior Counsel, assisted by Sri Brijesh Kumar Verma, learned counsel for the applicant, submitted that the applicant is an Asha worker and according to the FIR the role assigned to her is only of brining the deceased Parvati to the nursing home/hospital of one Sandip ad Dr. Kalpana on 23.11.2019. It was during her delivery that Parvati died. An FIR was lodged against one Dr. Sandip, Dr. Kalpana, the owner of nursingh home/hospital and the applicant. Sandip has already been granted bail by a coordinate Bench of this Court on 12.01.2022 in Criminal Appeal No. 2878 of 2021, copy of which has been brought on record as annexure No. 9 to the appeal. Learned Senior Counsel submits that while granting bail to Sandip, coordinate Bench of this Court had taken note of fact that the surgical operation has been conducted by one Dr. Anurag, who is dully qualified surgeon and is having MS degree. Sri Singh further contended that the role assigned to the applicant, as per the prosecution story, is only of bringing the deceased Parvati to the nursing home/hospital and except that no other allegation is against the applicant. Applicant is languishing in jail since 07.01.2022 and undertakes that she will not misuse the liberty, if granted.
