his land situated at Natwa Tehsil Sadar, District Mirzapur. The respondent no.2 had a look of the land and agreed to purchase two biswas of land from the appellant at the rate of Rs. 10,00,000/- per biswa. On 26.07.2015, respondent no.2 paid the present appellant Rs.1,00,000/-. On 08.09.2015, he paid him Rs. 3,60,000/- vide cheque no. 908875 and on different dates paid the rest amount of Rs. 15,40,000/- also. Thus, he paid the total amount of Rs. 20,00,000/- and asked the appellant to execute sale deed in his favour. After repeated requests appellant did not execute the sale deed in his favour. On 04.06.2016 at 7:00 PM the appellant visited the house of respondent no.2 and hurled caste based abuses, refused to execute the sale deed and warned that he had implicated various persons in fraudulent cases after taking money from them and in this case also he would neither return the money nor execute the sale deed and if he would insist on executing the sale deed he would also be implicated in false cases or would be murdered. He gave him threat of dire consequences and hurled caste based abuses and humiliated him. The respondent no.2 informed regarding the incident at police station Vindhyachal on 06.06.2016 but no steps were taken against the appellant. The appellant again visited his house on 18.07.2016 at about 8:30 AM and hurled caste coloured abuses and asked him to forget about the land. On the basis of these allegations present F.I.R. was registered against the appellant- Dhaneshwar Tiwari @ Dhaneshwar Nath Tiwari under Sections 406, 419, 420, 504, 506 I.P.C. and Section 3(1) (X) of SC/ST Act.
