The present criminal appeal has been filed to stay the further proceedings as well as to set aside the summoning order dated 4.3.2022 and non-bailable warrant dated 14.4.2022 in S.T. No. 62 of 2019, u/s 147/148/307/323/504/506 I.P.C. and 3(2)5 of S.C./S.T. Act, Case Crime No. 235 of 2013, P.S. Kotwali Sadar, District Deoria
Learned counsel for appellants submits that present appeal may be dismissed as not pressed with liberty to file a bail application which may be decided in view of law laid down by Supreme Court in "Satender Kumar Antil versus Central Bureau of Investigation and another, Special Leave to Appeal (Cri)No.5191 of 2021" to which learned A.G.A. has no objection.
Learned A.G.A. has no objection to this innocuous prayer of learned counsel for the appellants.
Accordingly, without entering into merits of the case, the present appeal is disposed of permitting the appellants to surrender before the trial court within fifteen days from today and file bail application, which may be decided expeditiously by the learned trial court in view of law laid down by the Apex Court in Satender Kumar Antil (supra).
