The submission of learned counsel for the applicant is that the applicant is having no criminal history and he is in jail since 15.11.2021 and the possibility of conclusion of trial in near future is very bleak. It is further submitted that initially the FIR was lodged on 26.09.2021 against unknown persons. Thereafter, on 15.11.2021, the applicant and co-accused Dharmendra were apprehended by the police concerned. The prosecution has shown recovery of a mobile phone and a knife as also Rs. 1200/- from the possession of the applicant. The recovery shown is planted as there is no independent public witness to it. It is further stated that co-accused Dharmendra, against whom the accusation is similar to that of the applicant, has already been released on bail by this Court vide order dated 14.02.2022 passed in Criminal Misc. Bail Application No.3744 of 2022. Accordingly, the applicant is also entitled for bail. It is also submitted that there is no apprehension that after being released on bail, he may flee from the course of law or may otherwise misuse the liberty of bail.
