It has been contended by the learned counsel for the applicant that the applicant has been falsely implicated in the present case due to ulterior motive. It is next contended that the applicant is the husband of the deceased and has not committed the offence in question. It is further submitted that in the dying declaration, it has been stated that while the father-in-law of the deceased was quarreling with the deceased and diverting her attention, her husband (applicant) or her brother-in-law, Deepak set her afire. It is urged by the learned Counsel for the applicant that the deceased's brother-in-law (Dewar), Deepak has been admitted to bail by the Hon'ble Supreme Court in S.L.P. (Criminal) No.4672 of 2020 vide order dated 27.10.2020, a copy of said order has been annexed as annexure-8 to the affidavit accompanying this bail application. So far as the applicant is concerned, his role or complicity is similar that of Deepak. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the accused has also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required.
