Heard learned counsel for the applicant, the learned A.G.A. and perused the record.

This is a bail application on behalf of the applicant in connection with Case Crime No.114 of 2021, under Sections 147, 148, 149, 307, 302, 336, 504 I.P.C., Police Station Matsena, district Firozabad.

The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. Learned counsel for the applicant has further submitted that the co-accused Kuldeep @ Dilip has been granted bail by Coordinate Bench of this Court vide order dated 18.4.2022 passed in Crl. Misc. Bail Application No. 1741 of 2022, copy of the bail order has been produced which is taken on record. Learned counsel for the applicant has further submitted that the role assigned to the present accused is similar to that of the co-accused Kuldeep @ Dilip, who has been granted bail, hence parity has been claimed. He submitted that the applicant is languishing in jail since 15.01.2022, hence he is entitled to be released on bail and he will not misuse the liberty of bail and will cooperate in the trial.

Learned counsel for the complainant, Sri Vijay Tripathi as well learned A.G.A. have opposed the bail plea.
