Learned counsel for the applicant has argued that a first information report has been lodged by Mohammad Qamil son of Roshan Bux before P.S. Bahedi, District Bareilly being FIR No.0997 in the above noted sections against the applicant, her husband and other co-accused, who are six in number. Learned counsel for the applicant has further argued that the complainant happens to be an Addl. District Government Officer in Moradabad, he owns certain ancestral properties, when he scrutinized the records of the porperties so owned by him, then it revealed that the certain land has been pledged before the HDFC Bank for taking loan. Learned counsel for the applicant has further argued that she has been falsely implicated in the case, as the photograph of the applicant has been deliberately affixed on the loan document, she has, at no point of time, taken the loan, as the property does not belong to her. Learned counsel for the applicant has next contended that one Sri Kamlesh Kumar Gangwar, who is also a co-accused in the said FIR has been enlarged on bail in Crl. Misc. Bail Application No. 47041 of 2019 on 29.1.2020 and similarly, the husband of the applicant being Sri Shareef Ahmad, who has also been nominated as an accused, has been enlarged on bail on 7.8.2020 in Crl. Misc. Bail Application No.20807 of 2020.
