Heard learned counsel for the applicant, learned A.G.A for the State and perused the record.

It is submitted by learned counsel for the applicant that he is innocent and has been falsely implicated on account enmity. There is general allegation against the applicant including other co-accused persons who has granted bail by learned trial court. There was no intention to cause grievous injury to the victim by the applicant. Nature of injuries found on the person of victim are not grievous except injury on eye. There is no criminal history against the applicant. He is languishing in jail since 21.9.2021 and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.

Learned AGA opposed the prayer for bail.

Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties and without expressing any opinion on the merits of the case, the Court is of the view that the applicant has made out a case for bail. The bail application is allowed.
